Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the BizHub platform and related services (the "Service") provided by Cybergate Services Private Ltd ("BizHub", "we", "us"). By creating an account, accessing or using the Service, you agree to these Terms.

1. Definitions

"Business" means the organisation that subscribes to BizHub. "User" means any person authorised by a Business to use the Service. "Customer Data" means data submitted to or stored in the Service by a Business and its Users.

2. Accounts

You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must notify us promptly of any unauthorised use.

3. Acceptable use

You agree not to: (a) use the Service for any unlawful purpose; (b) send spam or unsolicited messages in breach of applicable law or platform rules; (c) attempt to gain unauthorised access to the Service or other accounts; (d) interfere with or disrupt the Service; or (e) misuse data obtained through connected platforms such as Meta or WhatsApp.

4. Third-party platforms

The Service integrates with third-party platforms including Meta (Facebook & Instagram) and the WhatsApp Business Platform. Your use of those integrations is also subject to the respective platforms' terms and policies. You are responsible for obtaining any consents required to message your customers and to process leads, and for complying with applicable laws and platform rules.

5. Subscriptions & billing

Paid plans are billed in advance on a recurring basis in Sri Lankan Rupees (LKR) unless otherwise agreed. Fees are non-refundable except as required by law. We may change pricing with reasonable prior notice; changes apply from your next billing cycle.

6. Customer Data & ownership

As between the parties, the Business owns its Customer Data. You grant us a limited licence to host and process Customer Data solely to provide and support the Service. Our handling of personal data is described in our Privacy Policy.

7. Intellectual property

BizHub and all related software, designs and trademarks are owned by Cybergate Services Private Ltd. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service.

8. Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted operation. We may perform maintenance and may modify or discontinue features with reasonable notice where practicable.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law.

10. Limitation of liability

To the maximum extent permitted by law, BizHub will not be liable for any indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill. Our total aggregate liability arising out of or relating to the Service will not exceed the fees paid by the Business in the 12 months preceding the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or non-payment. On termination, you may request export or deletion of Customer Data as described in our Privacy Policy and Data Deletion Instructions.

12. Governing law

These Terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have exclusive jurisdiction over any disputes, subject to any mandatory consumer protections in your jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use after changes constitutes acceptance.
